Important studio Terms and Conditions

Below are the studio terms and conditions which clients are required to agree to before commencing classes with Westmere Pilates ltd or

Your use of our services is governed by these terms and any policies or any separate terms and conditions we may publish from time to time on our website (together the “Terms”). By attending the studio you are confirming to us that you accept these Terms. We may change or update the Terms at any time by posting changes to our website.

Current rates for Pilates sessions and other services are available on our website ( or and are subject to change from time to time.  Any changes will be posted on our website.

Payment is required in advance for memberships and within 5 days of invoice for sessions not covered by the membership.

If a booked appointment or session needs to be cancelled, please give us as much notice as possible. Appointments or sessions cancelled with less than 24 hrs notice will be fully charged.

Dancers please note that unlike group studio sessions, all 'finer' classes and programmes run per school term. 'Finer' sessions are non-transfereable, term payments are non-refundable and missed sessions cannot be made up at other times.

Membership Terms:
Memberships are to be paid by fortnightly automatic payment. Payment should be received in the Westmere Pilates account by the Monday of the first week of the fortnight.

As a member you/’the client’ receives 1/2/3 regular sessions per week. If you cannot make your regular session in any week, you may use our online booking system and replace your regular session with another session if the regular session cannot be attended. Regular sessions that are missed expire after 4 weeks.

Please note that the studio is closed on bank holidays and for 2-3 weeks over Christmas.
Memberships may be suspended for 4 weeks or more provided we are given 4 weeks notice. Please provide four weeks notice of membership termination.

Other terms:
To help you get the best from our services, we collect and keep information about you and the services we provide you. This information includes the information you provide on your enrolment form, updates you may tell us (for example about injury or pregnancy) and session notes we record about you. You need to make sure that all information you give us is true, correct and complete. Sometimes we may contact your other health care/education providers (for example doctor, osteopath, dance teacher etc) to exchange information about your general health and wellbeing, any injuries or illness you may have or any other concerns we may have about you and, by agreeing to our terms you give us permission to do so. If you do not wish us to share this information please request this in writing. Aside from this limited exception, your personal information is kept by us confidentially and we will not intentionally share your personal information with any third party unless we are required to do so by law or for the purposes of credit references or collecting unpaid fees. Under the Privacy Act 1993, you have the right to ask to see the information we hold about you. And if you notice that any of your details are incorrect just ask us to correct those for you.

We use online customer relationship software and an online booking system in which we keep your contact details basic goals and issues plus session notes. We also use for video feedback. These are hosted in secure environments and protected by username and password. While we have taken precautions to ensure information remains confidential and secure at all times and it will not willingly be passed on to any third party, the nature of online databases means that this is always a risk. For this reason we ask you to inform us of any specific details that you would not like stored in the systems.

By attending the studio you give Westmere Pilates ltd/ permission to contact medical specialists and consultants who have relevant information in reference to you/the client described above.

Exercise is not without its risks and participating in Pilates sessions may result in injury. To reduce the risk of injury it may be advisable to consult your doctor before you start to train with us, particularly if you have a medical condition, are taking medication or have any related concerns. Remember at all times to use common sense and tell an instructor or your doctor if you are experiencing any pain or discomfort during or after any session.

To the extent permitted by law, we exclude all warranties whether express or implied in relation to the services we provide to you, that are not expressly stated in these Terms. This includes any warranties relating to the availability of our services or any guarantees as to results or outcomes you may expect to achieve. Our sole liability to you and anyone else who uses the services we provide to you (together) will be to pay you up to a maximum combined amount equal to $300.

We exclude all other liability we or any of our related companies, agents, officers, or employees may have to you to the maximum extent permitted by law. This exclusion applies whatever you are claiming for (whether for direct, indirect or consequential losses,) and in whatever way any liability might arise if it were not for this clause (including in contract, tort, equity or under statute).

If for any reason we feel we cannot continue to provide services to you we may stop providing our services to you at any time.

Release and Waiver:
You/the client will assume full responsibility while voluntarily participating in any training class at your/their sole risk.
